Dear customers from Spain!
The EU bureaucracy madness continues. If you would still like to order something, please do so by 31 December 2024 and preferably in stock.
After that we will stop delivery to Spain. Just as we have already had to do with Romania, France, Latvia and many others. It is simply not worth appointing a "packaging representative" for each country, who costs around 2-3 times as much as the net profit we make per year from our sales to the country.
Attached is the latest news on the subject, which we received today as an email from our packaging service provider in Germany.
Thank you for 15 years of loyal customers and have a healthy 2025!
"Spain packaging in circulation?
Dear Mr Müller,
Today we would like to inform you about two important legal changes in Spain that could be relevant for your company:
1. new labelling requirements for packaging from 01.01.2025
2. obligation to register with the Spanish Ministry MITECO by 31.12.2024
Labelling requirements in Spain
From 1 January 2025, sorting instructions on packaging will be mandatory in Spain. This regulation may also affect your company.
We have compiled the most important information to help you prepare.
With the current packaging law (Real Decreto 1055/2022), which came into force on 28 December 2022, sorting instructions on packaging will be mandatory in Spain from 1 January 2025.
Who is affected?
Companies that sell packaged products to end consumers and whose packaging accumulates as waste in private households are affected.
What does this mean for you?
You can affix the sorting label on a voluntary basis until 31 December 2024. From 1 January 2025, however, this will be mandatory for all packaging that accumulates as waste with private end consumers in households.
Mandatory MITECO registration for B2B companies in Spain
By 31 December 2024, every company that offers products and goods in the B2B environment on the Spanish market must register with the Spanish Ministry MITECO. This registration must take place regardless of whether the company in question has a registered office in Spain.
Registration with the Spanish Ministry MITECO will be mandatory for some companies in the B2B environment from 31 December 2024.
Who is affected?
Companies that operate in the B2B environment and place their packaging on the Spanish market.
What needs to be considered?
Companies that are not based in Spain must appoint an authorised representative to ensure that their packaging is properly included in a take-back system."
End of the quote
This regulation with the authorised representative has been in place for B2C, i.e. parcels from us to private customers, since 2023, so since then all customers have had to provide some kind of business address where we could send the order to a company or employer. This loophole has now been closed. What a pity, dear EU!
